Are e-signed waivers really enforceable?

Yes. In the United States, the Uniform Electronic Transactions Act (UETA) and ESIGN Act place electronic signatures on the same legal footing as pen and ink. In the European Union, eIDAS provides a standardized legal framework for electronic signatures, ensuring their validity and recognition across all EU member states.

For a waiver to hold up in court the signer must:

  • Intend to sign
  • Receive an unaltered copy
  • Leave an auditable trail
